CLAIROL PROFESSIONAL "GO FROM GRAY TO GORGEOUS" CHALLENGE

OFFICIAL RULES

  1. HERE'S HOW IT WORKS:
    Submit one recent "before" photo (taken within the last 6 months) that shows how you looked before using Clairol Professional Beautiful Collection's Advanced Gray Solution and one "after" photo (taken between 4/1/09 and 6/15/09) showing how you look after use. You must also provide your original 100-word or fewer statement describing how Beautiful Collection Advanced Gray Solution transformed your look and how your new hair color made you feel emotionally. See Rule #3 for entry instructions and photo requirements.
  2. ELIGIBILITY:
    Open only to residents of the 50 United States and the District of Columbia, 18 or older at time of entry. Employees of Procter & Gamble, its affiliates, subsidiaries, advertising and promotion agencies and their immediate family members and/or those living in the same household of each are not eligible. All federal, state and local laws and regulations apply. Void where prohibited by law.
  3. TWO WAYS TO ENTER:


    1. ONLINE: Beginning 9:00 a.m. (ET) on 4/1/09, visit www.clairolpro.com/gorgeous and follow the on-screen instructions to complete the Entry Form, upload your before and after photos (as described above in Rule #1) and enter your 100-word or fewer original statement describing how Beautiful Collection Advanced Gray Solution transformed your look and how your new hair color made you feel emotionally. Photos must be of entrant only. No other person(s) permitted in photos in whole or in part. Online photos must be must be in color and jpeg (.jpg) format only, with a file size of up to 2 MB. Online submissions (photos and written statement) must be received by noon (ET) on 6/15/09. Limit one online submission per email address per day. If more than one online submission is received per person per day, only the first such submission received will be eligible.
    2. VIA MAIL: On a plain piece of 8-1/2" x 11" paper, hand print your first and last name, street address (no P.O. boxes), city, state, zip code, date of birth (mm/dd/yyyy), daytime and evening telephone numbers including area code and your original 100-word or fewer statement describing how the "Gray to Gorgeous" transformation made you feel emotionally. Mail your completed Entry Form/plain paper along with your before and after photos (as described above in Rule #1), to: Clairol Professional "Go from Gray to Gorgeous" Challenge, 30 E. 60th Street, New York, NY 10022. Photos must be of entrant only. No other person(s) permitted in photos in whole or in part. Mailed photos must be in color, unframed, un-mounted and must be no smaller than 3" x 5" and no larger than 8" x 10". Slides or transparencies are not eligible. Limit one mailed submission per outer mailing envelope. Mailed submissions must be received by 6/15/09. No mechanically reproduced submissions permitted. Sponsor is not responsible for any incomplete, illegible, lost, late, postage due, mutilated, damaged, or misdirected submissions.
    Some entries will be randomly selected and posted on www.clairolpro.com/gorgeous. An entry's posting will not have any bearing on winner determination or winning a prize. All material submitted becomes property of Sponsor and will not be returned. Entries must be submitted in English. You may enter as often as you wish, however, each submission must be different and sent separately. Submission must be your original work that has not been previously published nor won a prize or award. Modifying, enhancing or altering a third party's preexisting work does not qualify as Entrant's original creation. The submission cannot contain any unacceptable clothing or adornments, or display any commercial/corporate advertising (other than Clairol) (including but not limited to corporate logos, brand names, slogans, political, personal and religious statements) and they must not contain defamatory statements (including words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group); they must not include threats to any person, place, business, or group; they must not invade privacy or other rights of any person, firm, entity, and they must not in any way violate applicable federal, state, or local laws and regulations as determined by Sponsor, in its sole discretion. Submissions may not contain indecent behavior, profanities or obscenities, including but not limited to nudity, or pornography, and may not in any way disparage persons or organizations associated with Sponsor; sponsor/judges reserve the right in their sole discretion to disqualify any submission that, in their sole opinion, refers, depicts or in any way reflects negatively upon the Sponsor, the Contest or any other person or entity, or does not comply with these requirements or these Official Rules. Submissions must be suitable for presentation in a public forum, in sole determination of judges and/or Sponsor. If submission contains any photo(s) which were taken by any person(s) other than the entrant, by entering this sweepstakes, entrant agrees to receive permission from that person(s) (or from photographer's parent/legal guardian if photographer(s) is considered a minor in his/her state of residence) for Sponsor to use their photo(s) for publicity including, but not limited to posting on website(s) and can make written copies of such permissions available to the Sponsor upon request.
  4. JUDGING:
    Submissions will be judged by the Clairol Professional Design Team Panel to determine the Grand Prize winner. All judging will be based on the following criteria: Originality and Creativity of Statement - 50%; Appropriateness of Statement to Photos - 20%; Appropriateness to Theme as Evidenced in Statement - 20%; Appropriateness to Theme as Evidenced in Photos - 10%. In the event of a tie, tied submissions will be broken based on the highest score for Originality and Creativity of Statement. Decisions of judges are final.
  5. PRIZE:
    (1) Grand Prize - A 3-day/2-night trip for 2 to the 2010 Gospel Music Festival in Chicago, IL, in the summer of 2010, including round-trip coach air transportation from major airport nearest winner's home, hotel accommodations (double occupancy), a pair of priority- seating admission tickets to the festival and a $500 American Express gift card for winner (Approximate Retail Value: $3,000). Winner is solely responsible for all other expenses not specifically set forth herein, including but not limited to meals, additional transportation, souvenirs and other incidentals and items of a personal nature. The actual retail value of the prize will depend on winner's point of departure/return. Prize consists of only those items listed as part of the prize.
  6. GENERAL RULES:
    Potential winner (or parent/legal guardian if potential winner is deemed a minor in his/her state of residence) will be required to complete an Affidavit of Eligibility certifying that the submission is his/her own original work and he/she holds all rights to the submission, that the submission has not been previously published, has not won a previous prize or award and that he/she followed the Official Rules of the Contest and that he/she grants permission to post the entry submission online, in Sponsor's sole discretion. Additionally, potential winner (or parent/legal guardian if potential winner is a minor) will be required to complete a Release of Liability, Prize Acceptance Form and, if legally permissible, a Publicity Release. All documents must be completed and returned within 10 days of attempted delivery of same. Noncompliance within this time period or return of any prize/prize notification as undeliverable will result in disqualification and an alternate winner will be selected, if time permits. Winners will be notified by mail. Traveling companion (or parent/legal guardian if traveling companion is a minor) must also complete and return a Release of Liability within 10 days of winner's attempted notification. If winner is a minor, winner's parent/legal guardian will be required to accompany winner on trip and will count as the winner's guest. If a minor is selected as a traveling companion, winner must be his/her parent/legal guardian. All travelers must possess required travel documents (e.g., valid photo ID) prior to departure. All travelers must agree to depart and return on dates specified by the Sponsor; dates of departure and return are subject to change. No substitution or transfer of prize by winner permitted. Sponsor reserves the right to substitute prize of equal or greater value. All applicable taxes are the sole responsibility of winner. In no event will more than the stated number of prizes be awarded. All material submitted becomes the sole property of Sponsor and none will be returned. Sponsor/judges reserve the right to reproduce the submissions in full or edit and enhance the submissions at its discretion. Sponsor is authorized to use submissions as it sees fit, including usage in advertising and online without compensation. By accepting prize, winner (or parent/legal guardian if winner is a minor) agrees to hold Sponsor, its directors, officers, employees and assigns, harmless against any and all claims and liability arising out of use of prize. Winner (or parent/legal guardian if winner is a minor) assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize. Acceptance of prize constitutes permission for the Sponsor and its agencies to use winner's name and/or likeness and/or submission for purposes of advertising and trade without further compensation, including a winners' list, unless prohibited by law. Entrants (or parent/legal guardian if entrant is a minor) agree to release, discharge and hold harmless Sponsor, its directors, officers, employees and assigns, from and against any and all liability and damages. By participating in this promotion, entrants (or parent/legal guardian if entrant is a minor) agree to be bound by the Official Rules and the judges' decisions which are final. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any promotion materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. All material submitted becomes the sole property of Sponsor and will not be returned. Sponsor not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prizes.
  7. WINNER:
    Winner's name will be available at www.clairolpro.com/gorgeous after 7/31/09.

ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Not responsible for faulty, incorrect or mistranscribed phone transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in the promotion. Sponsor reserves the right to cancel or modify the promotion if fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the program as determined by sponsor/judging agency/administrator, in their sole discretion. In the event of termination, a notice will be posted online and the winner will be selected from among all eligible entries received prior to termination. Any damage made to the web site will be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry. Proof of submitting entries will not be deemed to be proof of receipt by sponsor. Any use of robotic, automatic, programmed or the like methods of participation will void all such submissions by such methods. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the account holder fails to comply with any requirement of participation as stated herein or with any provision in these official rules.
